Researchers aim to create virtual speech therapist

PHILADELPHIA (AP) ? Debi Green is trying to book a vacation, but she's having a hard time getting the words out. Even though it's been nearly nine years since she suffered a stroke, language sometimes fails her.

"I would like ... um ... um ... ," she said, faltering.

Luckily, the computerized travel agent has all the time in the world. It's an avatar being tested at Temple University in Philadelphia, where researchers are working to develop a virtual speech therapist.

Cyber-clinicians can be a crucial tool in overcoming the language disorder known as aphasia, experts say. While the verbal impairment can be life-long, health insurers only pay for a limited amount of therapy. Yet patients like Green need to continuously practice their skills.

"It's the adage of 'use it or lose it'," said Nadine Martin, a communication sciences professor at Temple.

The university's two-year study will add to the emerging field of virtual rehabilitation. About 1 million people in the U.S. are affected by aphasia, mainly as the result of strokes, according to the American Speech-Language-Hearing Association.

Whereas previous cyber-therapy options involve patients practicing conversational scripts with an avatar, Temple's approach challenges patients to spontaneously generate speech, said physical therapy professor Emily Keshner.

"They are actually put in a situation, which we hope is going to be natural, that requires that they come up with the correct words in the correct order," Keshner said.

In Green's case, she has been given a "brochure" so that she is forced to make choices about the trip. As Green responded, a doctoral student sitting behind her in the language lab quickly cut and pasted bits of dialogue for the virtual therapist to speak.

The goal is to build the avatar's vocabulary so that it can recognize all possible pronunciations of various words and respond with appropriate dialogue, Keshner said. A bigger test ? to come later ? is whether the avatar could be programmed to correct users who misspeak.

Another challenge is getting the character's lip movements right, said Leora Cherney, a researcher at the Rehabilitation Institute of Chicago.

"People with aphasia often get a lot of cues and assistance by watching the mouth movements of the therapist," said Cherney, who helped develop and market an early version of a cyber-clinician that uses the script approach.

Researchers also want to study whether patients respond differently to cyber- and human therapists. In addition, they are experimenting with the avatar's gender, ethnicity and voice texture.

Deb Diraddo, a speech-language pathologist at Magee Rehabilitation in Philadelphia, is not involved in Temple's project but said she's excited by its premise. She said she'd be "interested to see what the virtual therapist can pick up on and how it adapts."

But, she noted, "communication is not just the words ? it's the body language, the tone, the gesturing."

After booking her "trip" to Florida, the 49-year-old Green said it doesn't make a difference to her whether the therapist is human. She just wants to improve her communication skills.

"I guess I'll try anything," Green said. "Anything."

(AP) ? When Michael Phelps walked away from swimming after the London Olympics, he was adamant about one thing: His career was over.

Now, it sounds like he's not so sure.

While saying he's never been happier with his life ? and certainly doesn't miss the grind of what it took to become the most winningest athlete in Olympic history ? Phelps left the door open to change his mind before the 2016 Rio Games.

"I don't know what's going to happen in the future," Phelps said Monday. "I don't know what's going to happen tomorrow."

In Barcelona for the world swimming championships, Phelps spoke to The Associated Press and other international media organizations in a series of one-on-one interviews set up by his sponsor, Speedo. When asked by the AP, yes or no, whether he'll compete at the next Olympics, Phelps coyly said he hasn't planned that far ahead in his life.

That's a striking change from his comments before and immediately after the London Games, when he insisted his retirement was set in stone and it had always been his goal to quit swimming before he tuned 30.

Phelps will be 31 at the time of the opening ceremony for the Rio Games.

"I don't know. We're in 2013," he said, before adding, "There's nothing in the works right now."

There's plenty of time for a comeback. Phelps would likely want to begin training before the end of the year, which would allow him to get into peak condition leading up to the next world championships in 2015, an important stepping stone for the Olympics.

Phelps certainly isn't training at the moment. He jammed the small toe of his right foot on the edge of a sofa while at home in Baltimore, and aggravated the injury when he played in a golf tournament at Lake Tahoe.

He's wearing a boot cast on his foot while in Barcelona to cope with a small stress fracture.

After some sightseeing and promotional appearances, Phelps took in a second night of swimming at the Palau Sant Jordi before getting ready to head back to the U.S. on Tuesday. He was accompanied by his new girlfriend, Golf Channel reporter Win McMurry.

"I have no plans to do anything," Phelps said. "I love what I'm doing now. I'm able to travel so much, play golf. I'm on my schedule. I've never been able to have that. I've never been able to do really whatever I want to do. I go wherever I want to go. I see whatever I want to see. It's nice waking up at 10, 11, 12 o'clock in the afternoon. I'm pretty lazy besides playing golf. I don't do much."

He does have some projects away from the pool, including a series of swim schools and a foundation devoted to water safety. He said those are fulfilling projects, but he's still trying to sort out where he wants to go in his life.

"Peter (Carlisle, his agent) asked me where I want to be in one year, five years and 10 years," Phelps said. "I'm still in the process of putting everything down on paper."

While passionate about golf, Phelps seems to realize it doesn't present much of a career path other than playing in celebrity tournaments. He once talked bravely about not setting any limits on how far he could go in the sport, even joking that the only way he would be at the Rio Games was at a golfer (the sport is returning to the Olympic program in 2016).

But the game has clearly humbled him since London, despite getting lessons from famed coach Hank Haney as part of a show for the Golf Channel.

"I'm competitive in everything," Phelps said. "But golf has a very slow learning curve. For me to be able to get where I want to be, it's going to take some time to get there. It's not something that's going to take 24 hours and, bang, I'll be able to shoot par and be a scratch golfer. It's so annoying. It's probably the most humbling thing I've ever done, the most humbling sport I've ever done, the toughest thing I've ever done."

Phelps' competitive side showed after the U.S. men lost in the 400-meter freestyle relay on Sunday. The Americans were edged at the finish by the French, a repeat of last summer's Olympics when a team that included Phelps also settled for silver.

"We should never lose that relay with the talent we have on the team," he said.

While vague on a possible comeback, Phelps was downright candid with this thoughts about the relay ? perhaps because the head coach of the U.S. men's team is Bob Bowman, who was Phelps' longtime coach and remains a good friend and business partner.

Phelps made his feelings known to Bowman in a series of blunt texts, suggesting the Americans should have gone with Jimmy Feigen in the leadoff spot and Olympic gold medalist Nathan Adrian as the anchor.

Instead, Adrian went first and Feigen took over for the finish despite being the least experienced member of the U.S. foursome. He acknowledged paying too much attention to the teams next to him, the Australians and the Russians, and not noticing the French coming up in an outside lane until it was too late.

"I was so fired up," Phelps said. "We have enough guys on that team who can swim faster than that, and that was just frustrating for me to watch."

Not frustrating enough to announce his comeback.

Not yet anyway.

That said, it's clear just about everyone on the U.S. team would love for Phelps to rejoin them in time for Rio. Though he always had to be treated a bit differently than everyone else because of his fame, he seemed to get along well with his fellow swimmers. He still stays in contact with many of them; in fact, he was hanging out with Allison Schmitt and Conor Dwyer at his home the day he hurt his toe.

Phelps has been catching up with the U.S. team during his quick trip to Barcelona.

"It was so good to see him. We miss him so much," said Missy Franklin, the star of the women's squad. "The team's not the same without him. But we still have an incredible team and he has taught us so much, and I think we're all excited to carry on his legacy after him."

The most experienced member of the team, Natalie Coughlin, said it was strange to be at a meet of this magnitude without Phelps.

"I haven't been on a team without Michael in 14 years, so this is pretty crazy," Coughlin said. "I would love to see Michael back. But I just want to see him be happy. He's enjoying his life right now and enjoying his time away from the pool and well deserved ? very well deserved."

Judge: 3 Penn State ex-officials to stand trial

HARRISBURG, Pa. (AP) ? Penn State's ex-president and two former top school administrators were ordered Tuesday to stand trial on charges accusing them of a cover-up in the Jerry Sandusky child sex abuse scandal.

Prosecutors showed enough evidence during a two-day preliminary hearing to warrant a trial for ex-President Graham Spanier, former vice president Gary Schultz and ex-athletic director Tim Curley, District Judge William Wenner concluded.

Wenner called it "a tragic day for Penn State University."

The men engaged in a "conspiracy of silence," the lead state prosecutor, Bruce Beemer, said during his closing argument. They covered up their failure to tell police about a 2001 allegation that Sandusky was molesting a boy in a university locker room shower, even after they were aware that police investigated complaints about Sandusky showering with boys in 1998, Beemer said.

The key testimony centered on a series of emails among the three defendants that discussed the 1998 and 2001 cases and the testimony of Mike McQueary, a former team assistant and quarterback who said he had immediately told Schultz, Curley and the late longtime football coach Joe Paterno that he had seen Sandusky molesting a boy in the shower in 2001.

Sandusky, a defensive coordinator under Paterno until his retirement in 1999, was convicted last year of 45 counts of child sexual abuse. He maintains his innocence and is appealing a 30- to 60-year state prison term.

Anthony Lubrano, a Penn State trustee who watched the two days of testimony, said he had not expected Wenner to throw out the case, given the low level of evidence necessary to send the case to trial. However, he said, "if you get an unbiased jury (at a trial), it'll be hard to get those charges to stick."

Spanier testified to a grand jury that he was unaware of the 1998 investigation while Curley and Schultz testified that McQueary reported only that Sandusky and the boy were engaged in naked, inappropriate horseplay that made him uncomfortable. Once the defendants became aware of an investigation into Sandusky in 2010 or 2011, they did nothing to stop it, obstruct it or hide evidence, their lawyers said.

"What was reported was not a report of any activity that was sexual in nature," Spanier told the grand jury in testimony read aloud in court Tuesday. "I know better than to jump to conclusions about things like that."

The three were charged with perjury, obstruction, endangering the welfare of children, failure to properly report suspected abuse and conspiracy. Those charges include allegations of hiding evidence from investigators and lying to the grand jury.

Penn State and the Paterno family declined to comment.

Curley and Schultz were initially charged in November 2011, when Sandusky was arrested, and accused of perjury and failure to properly report the incident.

Spanier was forced out as president at that time. A year later, he was charged with covering up a complaint about Sandusky while additional charges were filed against Curley and Schultz. Spanier remains a faculty member on administrative leave.

Paterno was fired and died in January 2012.

Witness: Spain train driver said he went fast

SANTIAGO DE COMPOSTELA, Spain (AP) ? The driver of a speeding train that derailed in Spain, killing 78 people, said minutes after the crash that he had been going fast and couldn't brake, a local resident who rushed to the scene of the accident said in an interview broadcast Sunday.

Evaristo Iglesias told Antena 3 television that he and another person accompanied the blood-soaked Francisco Jose Garzon Amo to a stretch of flat ground where other injured people were being laid out, waiting for emergency services to arrive.

"He told us that he wanted to die," Iglesias said.

"He said he had needed to brake but couldn't," Iglesias said. He added that Garzon said "he had been going fast."

The television channel showed a photograph of Iglesias in a pink shirt and cap helping carry the driver after the Wednesday accident in Santiago De Compostela.

It also aired television footage of Iglesias working beside the wrecked train to help other survivors.

Garzon has been released from the hospital and is in police custody on suspicion of negligent homicide. He is expected to give testimony to an investigating judge later Sunday, though he exercised his right to remain silent when police tried to interview him.

The judge will also have access to information contained in the train's "black box," which is similar to those found on aircraft.

The train carrying 218 passenger in eight cars blazed far over the speed limit into a high-risk curve, tumbling off the tracks and slamming into a concrete wall, with some of the cars catching fire.

Authorities have pointed to speed as the culprit, and officials have said that the brakes should have been applied four kilometers (2.5 miles) before the train hit the curve.

Investigators must determine if Garzon failed to apply the brakes or whether it was a technical failure.

Iglesias was among survivors and witnesses who began to give evidence to police on Sunday.

Meanwhile, authorities said forensic experts have identified the last three bodies among the dead. They did not reveal the names of the dead, but said Sunday that all of the families had been notified.

Mourning continued throughout Spain, with Sunday church services being held in remembrance of the dead.

A large funeral mass is planned for Monday afternoon, and the prime minister and royal family are expected to attend.

Saudi billionaire prince Alwaleed bin Talal urges less reliance on oil

RIYADH: Saudi billionaire prince Alwaleed bin Talal has warned global demand for the kingdom's oil is dropping, urging revenue diversification and investment in nuclear and solar energy to cover local consumption.

In letters to officials and published on Sunday on his Twitter account, King Abdullah's nephew warned that it was alarming that "92 percent of the government budget relies on oil".

"The world's reliance on OPEC oil, especially the production of Saudi Arabia, is in a clear and continuous drop," he wrote in letter addressed to oil minister Ali al-Naimi.

He said the threat from shale gas is "definitely coming", pointing to progress in that sector in North America and Australia.

"Revenue diversification is a must, and that necessitates a clear vision that should be implemented immediately," the Arab world's richest businessman said.

He proposed creating a sovereign wealth fund to manage the kingdom's reserves, which he said stood at $676 billion in March, citing official figures.

Alwaleed also urged action to press ahead with plans to develop nuclear and renewable energy to "reduce local consumption of oil as soon as possible".

Alwaleed was 26th on the Forbes 2013 list of billionaires, with an estimated wealth of $20 billion -- but he challenged the rating, saying he was worth $9.6 billion more.

NBA free agency: Greg Oden could pick new team by Monday

Greg Oden could decide which team he'll make his comeback with by Monday.

Greg Oden could be ready to decide where he'll continue his comeback as early as Monday, according to NBA.com's Steve Aschburner. Aschburner added that the Miami Heat, San Antonio Spurs, Sacramento Kings, Atlanta Hawks, Dallas Mavericks and New Orleans Pelicans were among the teams to watch Oden work out at his highly-publicized workout last week.

Bill Duffy wouldn't detail the conversations he's had with other teams, but Oden's agent says talks have "ranged from general conversation to more specific terms, as the teams consider both the rewards and the risks of signing a premier talent whose body, thus far, has been unable to withstand the rigors of NBA play."

The 25-year-old hasn't played in an NBA game since Dec. 5, 2009, so it'll be nearly four years of inactivity between suiting up in the NBA. That kind of comeback is essentially unprecedented in basketball, but if anyone can do it, it's a once-in-a-generation talent like Oden.

Crean: "Among the returners, Will (Sheehey) and Yogi (Ferrell) just got back (from the World University Games). I would think that we're definitely going to see more from them. The key is that they continue to play the way they have ? only better. Not try to change what they need to do but do what they do better. It's just a matter of him being the highest level of competitor he can be day in and day out because his work ethic has really come to where he's become a 365-day guy, which he wasn't before. It took a little time. The guys who played with Will, with Victor (Oladipo), with Jordan (Hulls), they get it. They get what that gym does for you and what the extra work does for you. The young guys, it takes a little more for them to understand that it's not just about what everybody else is doing. They think they're working hard; everybody works hard. It's what you're willing to do extra above and beyond and what you're willing to absorb from what you do extra that begins to separate you.

"And I think Hanner (Perea) will be a different player as he figures out the game. Hanner and we're hoping Austin Etherington has the kind of season we expect he can have."

Can you talk more about Perea? Everybody is waiting to see what he's all about.

Crean: "Well, it wasn't just the time he missed because of the suspension, he also missed a lot of time health-wise. After he became eligible, he never had that chance to build consistency of effort. It's a matter of developing a feel for the game, being able to play in tight spaces. This year's team will have to try to create more offensive possessions off offensive rebounds and off defense more than we did last year. We could have more depth potentially, so that could give us a chance to be more of a pressure team. I think the more the game is wide open, the better it's going to be for Hanner, but he's got to learn to play in those tight spaces against double teams and people who might be bigger. He's got to be able to slow himself down in the post and I think he can do that. The trick is, can he play as well in the half-court as he can in an up-tempo game."

Is Peter Jurkin ready to take a next step and become a contributor?

Crean: "Well, he's still dealing with health issues. He still can't do a full workout, nor can Etherington. But Peter could transcend into a new position, a stretch 5 man for us, because he can really shoot the ball. He's done some half-court stuff where he comes out of nowhere and blocks shots. Now it's just a matter of him playing to his level of athleticism. But he can really shoot the ball."

Is coaching this team going to be a significantly different kind of challenge for you?

Crean: "Yes, a lot. We're young so we're not as physically strong as last year's team, and that's only going to come through repetition and hard work. We don't have the experience and don't have the understanding what the league and this level is all about. It doesn't happen all at once. You've got to incrementally build your role. Doc Rivers said you can't move on to another role until you've mastered the one you're in. It's a matter of players understanding it's not about the position you play but the position you can guard.

"There's a very youthful enthusiasm which gives us, especially me, a cautious optimism about where we can be. I think we can be a good team because we're going to get better. There's a lot of room for growth. But the bad news is, the reality is, four 1,300-plus point scorers are not out there, guys who not only scored the points but knew what it took to win."

As we sit here in late July, do you think you know who your starting five is or what your rotation is going to look like?

Crean: "I don't know yet. Really haven't given it much thought. The one thing I thought we'd have last year, and I mentioned this to you in Atlanta, I thought we'd have a consistency of depth. We just didn't have that last year. We've got to get there. Whether it was injuries or guys not working as hard to beat out other guys, we've got to have true competition not convenient competition.

"I think what happens sometimes when you get locked into where you're going to play and you know you're going to be able to do this regardless of whether you bring your best effort or not, sometimes that can trick you into thinking you're pretty good. We can't have that. We can't have convenient competitions. The work ethic of the young guys, they think they're working so hard now, that's not even close to where it's going to be. And that's their opportunity, their opportunity to separate, is what they do extra. It's not what we do as a group, everybody is working hard, it's the time you spend pushing yourself, your grit and your will that makes you special. Sheehey and Ferrell have developed that. Noah Vonleh is the youngest player in this program and Stanford Robinson, those two are in the same ballpark as where Victor and Will were when they walked in here.

"Vonleh, I haven't been around a lot of players his age who have the drive that he has. When Troy Williams figures this out, the sky's the limit. When Luke Fischer figures this out, the sky's the limit. When Devin Davis figures it out, the sky's the limit. Collin Hartman, that's going to be the difference."

MARCUS SMART: NBA draft decision

Can you give me a short synopsis of each of your freshmen and your other incoming players?

Crean: Noah Vonleh, incredible work ethic. He fits the exact culture of what this program has become, and that's a large part of the reason he came he. He's going to have an opportunity to leave (for the NBA) at a young age. He's got a drive but there's a humbleness about him. There's a real desire to get better. He knows what he doesn't know, and there's a real hunger to learn.

"Stanford Robinson has got to get better with both hands and shoulders, make plays not only in the halfcourt but in the open floor. But he's got a work ethic that I'm betting on him to be extremely successful here.

"(Collin) Hartman and (Devin) Davis have both dealt with some injury issues; they're very good players, but this is a whole different level here. And their ability to be in the gym and to work on their skill level, for them to get into the mix, it's going to have to be nonstop. It really is.

"Troy Williams, in my mind, is the best overall athlete to walk in here in our six years. He's like one of those NBA halftime acts, a contortionist, the way he uses his body and goes to the basket. He's got some unique abilities. I've also not been around that many who've improved more at the fundamental parts of the game once he dives into it. He's a great young guy who's just got to develop an extra-work mindset to go with that talent. But he can be a high-, high-level player here, and we're going to play him right away because he's too athletic not to use.

"Luke Fischer, we got a chance to see him recently, and we're starting to see what we saw during recruiting.

"As for (Evan) Gordon (the Arizona State transfer), he brings a lot to the table. There's a lot to his game we're going to try to bring out. There won't be any acceptance of him just being OK. He can improve his shooting, his ballhandling, driving, his pick-and-roll game, but he really understands the game. He's got to be instrumental for us not just because of his age, but because he understand how to play, how to win and how to move the ball. Now the question is whether he can drag some people along with him. We're going to put him in some leadership roles I'm not sure he's been in in the past. We have no choice. We've got two seniors. He instantly became the older player on our team the minute he got here."

It sounds like you'll be playing a lot of freshmen.

Crean: "Absolutely. No question about that. Real GM made a list of coaches and the percentage of freshmen they use. Obviously, John Calipari was at the head of the list. We were at 25 percent last year, but we're getting ready to grow that number, absolutely.''

Losing Oladipo, Cody Zeller, Hulls and Christian Watford, do you feel like you have to manage expectations?

Crean: "The thing I've learned here is we never try to get caught up in outside expectations. Because if we had coached this team in the beginning to the lack of expectations, I'm not sure we ever would have improved. Obviously, we didn't win many games. But if you were going by the common wisdom, you'd hardly show up for the game. Expectations should never be able to match up with the expectations you have for your own players.''

Do you think having Victor and Cody going Nos. 2 and 4 in the draft helps your program down the line?

Crean: "There's no question, and it helps the families of players we're recruiting know they can get both (an NBA opportunity and a degree). When we're recruiting, the 2 and 4 stand out, but the fact that one (Oladipo) graduated on his 21st birthday after three years, and the other one (Zeller) left just 35 hours short and would have graduated, that stands out, too.

"That's the kind of thing you can sell to a recruit and his family, that you can get the complete deal here. That's not saying we wouldn't recruit a one-and-done or a two-and-out; I don't think you put yourself in a box recruiting. But you come here, you can accomplish what you want to accomplish and walk out with a future after basketball."

With former Butler coach Brad Stevens having taken the Celtics job, have you thought about the NBA?

Crean: "Yeah, I had some opportunities as an NBA assistant at Marquette. I recently had a third party call me to ask if I'd be interested in talking to an NBA team's ownership group about a head coaching position. It took 10 minutes to say no. I think I have the best job in college basketball. I want to be at this for a long time. Hopefully it's the last job I ever have. I want to be here and have no desire not to be here. I look at this as a destination, the pinnacle of college basketball.''

Last thing, whenever your team loses, I hear the same things on talk radio or read it on Twitter or my email. Crean is a heck of a recruiter, but just an ordinary X's and O's game-day coach. Do you hear or see that? Does it get under your skin?

Crean: "Living in Milwaukee, we lived in a pro town. When you're at Indiana, the coverage for us is the same as the Pacers and Colts. People really care about the program. I don't feel judgment from that. The opinions that matter are the judgment of God and your family. Does that mean you like it? No. But my skin is a lot thicker than it was when I started and it better be. I've never felt I needed to defend myself. I read and study about other people in leadership positions, and all of them get criticized. It's not different when you're the coach of Indiana's basketball team. Honestly, it doesn't affect me.''

Tough Copyright Laws Chill Innovation, Tech Companies Warn Lawmakers

In a brief submitted to the House Judiciary Subcommittee on Courts, Intellectual Property, and the Internet, the tech industry warns that tougher copyright legislation may stifle innovation. The CCIA, which includes Google, Facebook and Microsoft as members, further points out that the devastating piracy numbers reported by the copyright industry often lack objectivity, and sometimes deserve the label ?fiction.?

Both sides often stress their interdependence, but also their differences in opinion. A new letter sent to lawmakers by the Computer & Communications Industry Association (CCIA) is an example of the latter.

On Thursday the House Judiciary Subcommittee on Courts, Intellectual Property, and the Internet organized a hearing on the role of copyright as a driver of innovation in the United States.

For copyright holders this was a good opportunity to remind lawmakers why they need strong copyright protections. On the other side, however, other voices tried to balance the debate by arguing that more copyright protections are no guarantee of more innovation.

The CCIA, which includes members such as Google, Microsoft and Facebook, submitted a statement debunking what they see as copyright industry propaganda. The tech industry association explains that tougher copyright can actually hinder innovation.

?Arguments that ever stronger regulation incentivizes innovation overlook the ways in which excessive protection can inhibit innovation,? the CCIA writes.

?Every year that a work is covered by a copyright is a year that subsequent users cannot build on that work. While incremental protection may provide additional reward to the author, society pays for this reward by being deprived of follow-on use, while the author and his or her heirs accumulate profits.?

?For this reason, protection exceeding the amount necessary to incentivize innovation represents a dead weight loss to the economy?

The tech companies provide many examples of how more enforcement can be detrimental to innovation. In addition, they stress that under current copyright law this is already taking place. Among other things, CCIA mentions that with statutory damages of up to $150,000 per copyright infringement, copyright holders can put enormous legal pressure on small tech companies.

?The threat of enormous damages encourages rights-holders to assert aggressive theories in the hope of coercing quick settlements, and also causes technology companies to withhold new products and services from the market. Effort to quantify the amount of innovation caused by IP must also account for the amount of innovation inhibited by remedies of this nature.?

The tech companies further note that copyright trolls are abusing high statutory damages to force individuals into paying settlements, such as in the numerous mass-BitTorrent piracy lawsuits that are currently ongoing.

?The feature of the copyright system that most incentivizes aggressive litigation postures, encourages trolls, and thereby chills innovation, is the availability of statutory damages in copyright infringement cases. Under [copyright law], a plaintiff can obtain up to $30,000 in damages for each work infringed, regardless of the actual injury it suffered.?

Finally, the tech companies say that the copyright lobby often uses subjective statistics to back up their requests for tougher copyright laws.

?For years, advocacy for stricter copyright has relied on rights-holder supplied data, some of which has been openly questioned by governments and intergovernmental organizations,? CCIA writes in its letter.

Among other examples they cite the Government Accountability Office report which found that there is no solid evidence that piracy leads to massive losses. The tech companies also cite several journalistic investigations, some of which describe the industry-funded reports as ?fiction.?

?Media investigations into the source of such industry-driven statistics have found little or no basis for these numbers, dismissing them as ?fiction.? Objective analyses indicate that rights-holder-funded research has drastically overestimated counterfeiting and copyright infringement costs,? CCIA writes.

The above are just a few highlights of the letter, which is available in full below. The document makes it crystal clear that on some topics the tech and copyright industry have certainly not settled their differences.

This makes Government plans to realign copyright law with the present times a tough project. Both sides are expected to crank up lobbying machines to make sure that their voices are heard.

Apple's smartphone market share slips

Apple's share of the global smartphone market fell during the second quarter to its lowest level in four years, according to data released Friday.

Apple took 13.1 percent of the worldwide market, according to ABI Research, down from 16.6 percent a year ago. That's the lowest level since the third quarter of 2009, two years after the launch of the first iPhone.

Apple Inc., based in Cupertino, Calif., sold 31.2 million iPhones in the April-to-June period, up from 26 million in the same period a year ago, the report said. But the company's sales growth isn't keeping pace with the overall smartphone market, which grew 52 percent from last year.

The No. 3 and No. 4 smartphone makers, LG Electronics of Korea and Lenovo Corp. of China, doubled their sales in the quarter, according to ABI research.

Samsung, the world's largest maker of smartphones, also saw a drop in market share.

Stocks drop at opening as investors take pause

Stocks went on a roller-coaster ride on Friday, ending with the Dow squeezing out a fifth consecutive week of gains, as investors digested the latest batch of mixed earnings ahead of a busy economic calendar next week.

The Dow Jones Industrial Average ended the day just 3 points ahead, after plunging nearly 150 points during the session. The S&P 500 and the Nasdaq eked out small gains also. The CBOE Volatility Index (VIX), widely considered the best gauge of fear in the market, finished below 13.

Among key S&P sectors, materials lagged, while health care rebounded.

"The market's had a good run near the highs and with earnings season about halfway through, we characterize the results so far as being lackluster to just OK," said Cam Albright, director of asset allocation at Wilmington Trust Investment Advisors. "As the year progresses, we're expecting the economy to start coming out of some of the doldrums from the fiscal impediments from earlier in the year?so we're expecting a better second half and that should help support the market and provide us with the basis to have prices move forward."

On the economic front, consumer sentiment rose to its highest level in six years, with the Thomson Reuters/University of Michigan's final reading on the overall index climbing to 85.1 in July from 84.1 in June. Economists surveyed by Reuters expected a reading of 84.

"This high level of confidence points toward a continued expansion of consumer spending in the year ahead," survey director Richard Curtin said in a statement.

But investors initially shrugged off the positive report, with the Dow plunging nearly 150 points soon after the report. Investors also hesitated to jump in ahead of next week's Federal Reserve's meeting and the widely-followed non-farm payrolls report.

"With the Fed meeting and non-farm payrolls due next week, there will be plenty of news to move the market in the week ahead," said Rebecca O'Keeffe, head of investment at Interactive Investor. "U.S. data has been more mixed in recent weeks, suggesting that next Friday's employment report may not be as good as recent months, in part because the housing market does look to have softened in light of higher interest rates."

Meanwhile, President Obama will not announce a decision about who will lead the Federal Reserve until the fall, according to a White House official. Current Chairman Ben Bernanke's term expires next January.

Among earnings, Amazon.com declined after the Internet retail giant reported an unexpected loss and issued a cautious current-quarter forecast as it continues to invest in new areas like cloud computing services.

Starbucks rose after the coffeehouse chain topped earnings expectations and also forecast current-quarter profit above Street consensus. The company also boosted its full-year guidance as its new menu offerings helped drive customer traffic.

More than 50 percent of S&P 500 companies have reported results so far this quarter, with 68 percent of firms topping earnings expectations and 56 percent beating revenue estimates, according to data from Thomson Reuters. If all remaining companies report earnings in line with estimates, earnings will be up 4.1 percent from last year's second quarter.

Activision Blizzard surged after the videogame publisher said it will buy back nearly $8.2 billion worth of Vivendi's holding in the company.

Japan's Nikkei tumbled to its lowest level in nearly three weeks, as the yen strengthened against the dollar, following an inflation report.

"They looked good with the headline number, but when you dig down and take energy out, they were deflationary again," said Art Cashin, director of floor operations at UBS Financial Services. "That spooked the Japanese market and the yen spiked against the dollar."

New, Cheaper Smartphone Plans

However much you pay every month for your cell phone service, it?s probably too much; between $80-100 a month if you own a smartphone. But good news: Facing stiff competition from budget carriers, all of the major networks recently began offering cheaper ?prepaid? plans ? which could save you a ton of money.

Prepaid Plans
Instead of entering a two-year contract, a ?prepaid plan? enables you to pay monthly, without a commitment to stay with a particular service provider. These no-contract, prepaid phone plans used to be just for dumb-phones ? you know, what the manufacturers call ?feature phones? (but actually have few usable features). Or, you could get a great deal if all you did was talk and text ? no need for web.

But then budget carriers like Straight Talk, Boost, and MetroPCS started offering monthly plans that included web access.

Consumer-driven Change
Consumers have done the math: Buying a phone up front and paying a lower monthly fee can be way cheaper than a two-year contract. And the demand for this kind of arrangement has shaken up the industry. According to a study by the NPD Group, by the beginning of 2013, 32% of all smartphone sales were prepaid models. That popularity has forced all the major carriers to roll out prepaid smartphone plans ? and that?s on their super fast 4G and LTE networks.

So now the world has really changed. Today, you can find $30 a month plans for even the newest smartphones.

The Deals

  • If you?re a heavy talk and data user, the best plan is on Sprint?s network through Boost Mobile: $50/month for 2.5 GB of data. (Compare this to Verizon and AT&T?s plans ? $60/month for 2 GB.) Better yet, if you make six, monthly, on-time payments in a row, Boost will knock $5 off your monthly bill every month thereafter. They?ll reduce your bill again at 12 months, and again at 18 months, so that after a year and a half you could be paying as little as $35/month ? if you haven?t switched plans by then.
  • If you don?t talk much but use a lot of web access (say, you?re a teenager), Virgin Mobile has a $35/month for 300 minutes of talk ? and unlimited text and data.
  • If you use a moderate amount of data but want unlimited talk and text, T-Mobile offers unlimited talk and text, plus 500 MB of data for $50/month.
  • The cheapest deal I?ve recently seen form the big carriers: If you dig down deep on T-Mobile?s prepaid plan page, you?ll find a plan with only 100 minutes of talk, but unlimited text and data for ? get this ? $30 a month.
  • And don?t forget the budget carriers who started it all: Straight Talk, Walmart Mobile, Ting, Giv Mobile, Simple Mobile. Many of these have $35 and $40 a month plans and if you?re willing to do the digging to find out about their coverage, speeds, and plans, they can be a great way to save.

Cautions:
Throttling: If you stream a lot of video or otherwise use a lot of data, some of these carriers will throttle your data - meaning they?ll slow your streaming way down

A prepaid phone is not the same as an unlocked phone: If you buy a prepaid phone from a carrier, it probably won?t work with another carrier?s service. If you buy an unlocked phone from a third party (like Amazon Wireless or Best Buy), you can use it with other carriers. But switching around has some limitations and you need to do your homework. Best bet is if you think you may want to switch carriers mid-stream, or if you travel a lot and want to pop in a local SIM card overseas, get an unlocked GSM phone.

What You Should Do
If your contract is up for renewal (or has already expired), you face a decision point ? go monthly or enter a new two-year contract.

If you own a phone you?re happy enough with, this is a no brainer. Shop around for a monthly plan that will work with your phone. If you can go from $90/month to $50, for example, that?s a savings of $960 over a two-year period.

If you need to buy a new phone, you have to factor in the cost of that phone, and the math becomes a little trickier. For example, say you currently pay $80/month ($40/month for 450 voice minutes, plus $20/month for 300 MB of data, plus $20/month for texts) on AT&T. That?s $1920 over two years. You could cut that back to their somewhat comparable $60/month plan and save $480 over two years. But if you want to buy a new Galaxy S4, and bring that over, you have to factor in the $619 cost of the phone ? comparing it to getting the same phone for $199 as part of a two-year contract.

Scott: NCAA changes can come without confrontation

HARTFORD, Conn. (AP) ? Larry Scott of the Pac-12 joined the chorus of commissioners calling for sweeping change in the NCAA, and said it can happen without confrontation and with the five most powerful football conferences still competing on the field with the other five.

Scott was the last of the leaders of the big five conferences to make a public push for NCAA reforms that will allow the schools with the most resources to have more freedom to determine how they use them.

"I don't think of it as much of an us vs. them situation as maybe is the impression out there," Scott said Thursday as the Pac-12 wrapped up a mini-media days on the East Coast that included their football coaches appearing on ESPN. "I'm certainly aligned with what you heard from my colleagues this week in terms of the need for transformative change, but I think it can be evolutionary and not revolutionary.

"I don't think it will be as confrontational and controversial a process as some of the reports I have heard this week."

NCAA President Mark Emmert told The Indianapolis Star on Thursday that he agrees with Scott and his fellow commissioners, and vowed significant changes to the way rules and policies are made.

"There's one thing that virtually everybody in Division I has in common right now, and that is they don't like the governance model," Emmert told the Star. "Now, there's not agreement on what the new model should be. But there's very little support for continuing things in the governing process the way they are today."

Emmert told the Star he will call for a Division I summit in January to discuss revamping how Division I is run.

Scott, Mike Slive of the Southeastern Conference, John Swofford of the Atlantic Coast Conference, Bob Bowlsby of the Big 12 and Jim Delany of the Big Ten have taken turns at football media days around the country over the past week calling for changes to the way the NCAA passes legislation since .

The most notable issue has been a $2,000 stipend that would be added to the athletic scholarship to cover the full-cost of college attendance. The big five conferences want to be able to give the stipend to all scholarship athletes.

"Schools that have resources and want to be able to do more for student-athletes are frustrated, concerned that we're being held back from doing more for the student-athletes in terms of the stipend," Scott said.

The stipend was shot down by some of the less wealthy NCAA Division I schools that might not be able to afford it. There are 349 schools in Division I, 125 at the highest level of college football called FBS.

"The idea that there is an even playing field in terms for resources is a fanciful and quaint notion," Scott said.

Scott compared the stipend being stymied to the delays in bringing instant replay to college football in 2000s.

"Instant replay took longer than it needed to get into college football because not everyone could do it," he said. "There are still some schools out there whose conferences can't afford instant replay. It doesn't strike me that the world's fallen in or that it's created some crisis just because everyone can't have instant replay."

Scott said university presidents that make up the NCAA board of directors will talk about reform when they meet next month. Proposals could come later this year.

Scott said he still wants FBS to have a "so-called big tent," with more than just the top five conferences being included.

"That's why the reports of a possible breakaway and things like that are overcooked," he said. "That's not anyone's agenda."

He said the move toward more nine-game conference schedules and an emphasis on strength of schedule in the upcoming College Football Playoff will naturally lead to fewer games between the big five conferences and the other five FBS leagues (Mountain West Conference, American Athletic Conference, Sun Belt, Mid-American Conference and Conference USA). But there will still be competition between the two groups.

What is likely to decrease are games between FBS and FCS teams and so-called guarantee games, when a school from a power conference pays hundreds of thousands of dollars to a school from a lesser conference to play a road game.

Some FCS and lower-level FBS programs, especially those in the Sun Belt and MAC, rely on those guarantee game payouts to fund their athletic programs and losing them could be a problem.

"I'm not very sympathetic. I just don't think the concept of buy games is a healthy thing for college football or for fans," Scott said. "It's been a quirk in the system that they've benefited from and good for them. I certainly don't feel like it's an entitlement or right they have. To me that's not a higher priority than creating higher quality college football matchups.

"There is plenty of socialized revenue distribution through the NCAA."

200 in 4 states had unidentified stomach bug

WASHINGTON (AP) ? More than 200 people in at least four states have come down with a stomach bug that could be linked to foodborne illness.

The Centers for Disease Control says the cyclospora infection causing diarrhea and other flu-like symptoms has been reported in Iowa, Nebraska, Texas, and Wisconsin. The CDC said eight people have been hospitalized and the reported illnesses occurred from mid-June to early July.

The Food and Drug Administration is investigating the cyclospora infections, which are most often found in tropical or subtropical countries and have been linked to imported fresh produce in the past.

The illness is usually spread when people ingest foods or water contaminated with feces. The agency said it isn't yet clear whether the cases from all of the states are linked.

Roc Nation Sports head Jay-Z is not done adding talent to his growing roster and reportedly has his eyes set on a South Carolina NCAA football star.

According to reports, college football defensive end Jadeveon Clowney has sparked Young Hov's interest.

Now, Inside the League is reporting that Jay has been keeping in contact with Jadeveon Clowney of South Carolina, who is projected to be a top three pick in next year's NFL Draft. Not a bad haul for Roc Nation Sports, if the report is true. Of course, we'll have to wait until next year to see if this actually happens. So, keep an eye out for Clowney throwing the diamond up after hits like this one. (Complex)

A few days ago, Jigga promised the creation of Roc Nation Sports would break old habits and lazy traditions set by sports agencies for years.

"Within two months we had Robinson Cano and Kevin Durant," Jay said in an interview referring to the New York Yankees and Oklahoma City Thunder superstars. "[The other companies,] they're fighting it. They're fighting it because it means you have to work now. You have to work now and they're not comfortable with that. They've been spending 15, 20 years just sitting back and collecting the check and now they have to get out, get up and they have to work and they have to care about these clients because they're going to see the work we're doing and say, 'Hold on, wait a second. Why am I not getting this sort of service? What are you doing? What have you been doing this week?' Those questions are going to start coming so they're intimidated by that. The fact that they have to work and they're intimidated by the fact their clients are going to want to come to us. But if they're doing a great job, there's no reason for any client to switch." The overnight sports agent also said he believed Roc Nation Sports will ultimately make agents reconsider how much time and effort they put into their clients' careers.

"This is people's lives. They think they're going to hang around me because I'm famous but they can do that anyway. They don't have to sign to Roc Nation," Jay added. "Those two reasons. They think their clients are going to leave them. Their conscience is telling them, 'I'm not really earning a check. I'm not really earning,' because if you're confident and I know that I've done a great job, I have no fear of that because, I'm doing a great job. But their conscience is telling them, 'I'm not doing what I'm supposed to be doing and this is not cool that someone's around that is threatening to really do the job. So I really have to get up now.' ... Some guys sign and they never see the agent. They see them on the signing day and just never them [again]. The Yankee second baseman has signed a national deal with Pepsi to be the face of Major League Baseball for the beverage company. Cano's first Pepsi ad will break at Citi Field during the All-Star game tomorrow. The Yankee slugger will also join Pepsi's passion-driven "Live for Now" campaign, of which Beyonc? and Blake Shelton are also participants. Cano signed with Roc Nation in April as the newly formed agency's first client, severing ties with his former agent Scott Boras. I?d now like to turn the call over to Ms. Kathy Martin, Vice President of Investor Relations for McDonald?s Corporation. Ms. Martin, you may begin.

Good morning everyone, and thanks for joining us. With me on the call are President and Chief Executive Officer, Don Thompson; and Chief Financial Officer, Pete Bensen. In addition, Chief Operating Officer, Tim Fenton is here Q&A. Today?s conference call is being webcast live and recorded for replay via the phone, webcast and podcast.

And before I turn it over to Don, I want to remind everyone that, as always, the forward-looking statements in our earnings release and 8-K filing also apply to our comments. Both documents are available at our website www.investor.mcdonalds.com, as a reconciliations of any non-GAAP financial measures mentioned on today?s call with their corresponding GAAP measures.

And now, I'd like to turn it over to Don.

Don Thompson

Thank you, Kathy, and good morning everyone. I?d like to begin by briefly framing our performance using three lenses. The past, the present, and the future.

First the past, because it provides perspective and guides our present and future. Throughout McDonald?s history, we respectively grown both the top and the bottom lines to varying degrees across a variety of economic and competitive cycles. We have an iconic brand an outstanding system of owner-operators, suppliers and employees and superb real estate locations in nearly every market around the world. This provides a solid foundation from which we operate.

Second, the present. In second quarter we grew revenues, operating income and earnings per share, despite the ongoing impact of the challenging environment. This is truly a testament to the fortitude and resilience of our system, our sustainable competitive advantages, and the collective focus on execution at our restaurants.

And third the future. We expect the dynamics of this cycle should persist in the near-term, namely flat to declining informal eating out markets, increasingly less ability to take price, cost pressures throughout our P&L and heightened competitive activity.

Our second quarter results tells story consistent with these lenses. Global comparable sales were up 1%, operating income was up 3% and constant currencies and earnings per share was $1.38, a 6% increase in constant currencies. And as we begin the third quarter, global comparable sales are expected to be relatively flat in July. Based on our recent sales trends, our results for the rest of the year are expected to remain challenged.

We remain committed to the plan to winning our three global growth priorities to optimize our menu, modernize the customer experience, and to broaden accessibility to brand McDonald?s around the world. This customer centric plan enables us to deliver an appealing experience by offering great tasting, affordable food and beverages, and clean and modern restaurants.

At the same time, we are diligently implementing thoughtful adjustments to our proven strategies and solutions when and where needed. This flexibility has enabled us to maintain or grow market share in most of our major markets around the world.

Let's review ours results in every geographic business units, starting with the United States, where comparable sales for the quarter were up 1% and operating income was flat. We continue to appeal to our customers with an increased emphasis on new news across our menu, and an ongoing focus on everyday affordable value.

The Dollar Menu remains a foundational component of our strategy to consistently deliver value across the menu, rather than implementing aggressive short-term discounting tactics. At the same time, our focus on enhancing core classics and offering additional premium products, continues to provide customers with even more variety and choices across day parts and price points.

This quarter we introduce new items across all four key growth categories, chicken, beef, breakfast and beverages. Premium McWraps launched in April, the Blueberry Pomegranate Smoothie and Egg White Delight debuted in May and last month we added fresh new taste to our Quarter Pounder Burgers with three new flavorful recipes, Bacon Habanero Ranch, Lettuce Tomato Deluxe and Bacon & Cheese.

From a comparable sales standpoint, these new menu additions individually met or exceed its targeted performance levels. However, softer IEO environment and comparisons against prior-year promotion was chicken and beverage activity offset the sales driven by the new menu news. And while June comparable sales were slightly negative in the U.S., we continue to outpace the competitive set.

In June, I met with our leadership franchisees while they were in Oak Brook for one their regularly scheduled meetings. While the challenges of operating a small business today are many, it is clear that we?re aligned and focused on what's most important and that's the customer. It?s that commitment to remaining customer centric, along with the assertive plans and vision we have in place, that enables all three legs of the McDonald?s system to grow sales and profitability for the long-term.

Let's shift to Europe, where comparable sales were down 10 basis points for the quarter and operating income was up to 5% in constant currencies. The U.K. and Russia continue to deliver positive results, while weak performance in Germany and France persist. The UK?s business remain solid. Second-quarter results and continued market share growth were driven by a balanced focus across value core new products, and promotional offers.

The U.K. launch blended ice beverages in June, just in time to satisfy customers? craving for something cool and refreshing during the summer months. The lineup includes two delicious fruit smoothies, strawberry and banana and mango and pineapple, and a line of frappes including Carmel and Iced Mocha.

Inspired by the U.S., these new products expand the overall beverage lineup and further validate blended ice as a proven system solution that can be deployed across markets worldwide. Russia also delivered positive performance for the quarter on top of last year's strong results. In addition to a focus on the Big Mac, two seasonal premium offerings, the Royal Cheeseburger and The Big Tasty with Bacon, contributed to Russia's performance and demonstrated the strong ongoing appeal of our brand in this growth market. We expect the lower inflationary environment in Russia to continue dampening our pricing power, pressuring near-term sales momentum compared to last year.

Moving over to France, comparable sales in guest count performance remain negative as the recession continues to pressure the informal eating out industry. However, we?re growing market share by balancing value in premium products across the menu. For example, France recently added two new recipes to the popular Casse-Croute entr?e and drink combo, they contributed to market share growth during the lunch day part. This value offer was complemented by a strong focus on two premium beef burgers, Le M and Le 280.

In Germany negative comparable sales and traffic trends persist. Our traffic has declined at a faster rate than the IEO industry, which also continues to contract. It?s critical that our initiatives resonate with consumers in this environment and in this marketplace. So to reestablish our momentum, we are leveraging recent consumer insights and continuing to adjust our plans.

Let?s shift to Asia Pacific, Middle East and Africa or APMEA. Comparable sales were down 30 basis points for the quarter and operating income increased 3% in constant currencies. Although market share improved in China, Australia and Japan, comparable sales were negative for our big three markets. Positive performance in other markets like South Africa, Singapore and South Korea partially mitigated the overall segments decline.

Markets across APMEA are taking a holistic approach to stimulating demand. Across day parts there are offering limited time and innovative products alongside established price value platforms. In Australia, we continued to grow market share by balancing our focus on the core with new product introductions and promotional activities. Strong performance in 2012 including the launch of our Loose Change menu along with external pressures in 2013 from lower levels of consumer spending and high competitive activity have contributed to weaker performance.

In Japan, consumers remain extremely price sensitive. Comparable sales have been positive the last two months and we continue to grow share by leveraging limited time offerings like the Chicken Teritama and sharing options such as the Mega Potato to keep customers coming back to our restaurants and to build our average check.

In China, comparable sales were down 6.1% for the second quarter reflecting the negative impact from avian influenza which continues to dissipate. We remain focused on leveraging promotional activities to showcase the diversity of our menu beyond chicken and strengthening our connection with customers through our ongoing brand trust campaign that focuses on the quality and the safety of our food.

We remain confident in our ability to drive future performance in China. Going forward, comprehensive plans for our key growth areas particularly beverages, the family business and the late night day part remain our top priorities.

Around the world and across our system we are focused on ensuring our strategies and tactics resonate with customers. That's the key, the key to our performance, today and for the long term. As I mentioned earlier, our market teams continue to strategically and thoughtfully adjust their plans in response to local consumer dynamics and growth opportunities.

At the same time, we remain committed to prudently investing our capital and resources in those initiatives that will further differentiate us from the competition for the long term. We're broadening accessibility by adding new restaurants, we're modernizing our existing restaurants with reimages and remodels and we continue to deploy technology and convenience initiatives.

As our predominately franchised business model continues to generate significant levels of cash, our priorities regarding the use of cash have not changed. After investing in our business, we're committed to returning all free cash flow to shareholders over the long term, first through dividend and then through share repurchases. For the second quarter, we returned $1.2 billion to shareholders through a combination of dividends and share repurchases.

In closing I want to reiterate my confidence in our business and in the growth opportunities that exists. We are diligently focused on executing the proven strategies within our plan to win. We have a resilient business model and aligned and talented system and an experienced management team.

We're leveraging these strengths and making deliberate, continued progress toward winning this battle for market share and fortifying our position as our customers' favorite place and way to eat and drink.

With that, I'll turn it over to Pete.

Peter J. Bensen

Thanks, Don, and hello everyone. McDonald's continued to grow revenues and net income in second quarter within the challenging global environment. The system remains focused on executing our strategies to become even more relevant to the 69 million customers we serve every day.

We continue to adjust our tactics where prudent and are committed to optimizing those factors within our control. Our financial results for the second quarter reflect these efforts to strengthen near-term performance while continuing to build our business for the long term.

For the six months ended June, system-wide sales increased 3% in constant currencies due to expansion. Combined operating margin declined 30 basis points to 30.3% over that same period, primarily due to lower restaurant margin percentages.

We are primarily a franchisor with 81% of our global restaurants operated by local business men and women. Consolidated franchise margins contribute approximately 70% of our restaurant profits. This stable, predictable income stream benefits from comparable sales growth and is more insulated from inflationary and other cost pressures.

For the quarter, each area of the world contributed to franchised margin dollars growing 4% in constant currencies to more than $1.9 billion. The margin percent declined 40 basis points to 82.8% as positive comparable sales were more than offset by higher occupancy expenses.

Global company-operated margin dollars declined 1% in constant currencies to $842 million for the quarter. The margin percent decreased 50 basis points to 17.7% as higher labor, commodity and other costs more than offset slightly positive comparable sales. The margin pressures for the quarter were most achieved in the U.S. and APMEA while Europe grew its McOpCo margin.

In the U.S., second quarter company-operated margins declined 110 basis points to 18.7% due to higher labor occupancy and other operating costs. The McDonald's system is effectively managing commodity expenses with cost up about 1% in second quarter. The full year outlook for the increase in our U.S. grocery basket remains at 1.5% to 2.5%.

The U.S. has been deliberate regarding pricing seeking to remain below the food-away-from-home inflation index of 2.2%. Another relevant data point is Food At Home index which is up only 0.9%, somewhat limiting our pricing power. At the end of June, our U.S. price increase was 1.5% which is about 120 basis points less than one year ago.

As we move through the second half of the year, we will consider future price increases balancing our desire to grow traffic and market share amidst the reality of higher input costs. In addition to pricing, we're employing more suggestive selling strategies at the order point to encourage trials, new products and add-on purchases. As Don mentioned, it's a market share battle so we're employing a variety of strategies and tactics to grow traffic and increase relevance to our consumers.

Turning now to Europe, company-operated margins were probably the biggest positive of the quarter as they increased 10 basis points to 19.4%. Europe's McOpCo margins benefited from the significant contribution from the UK and Russia, our two strongest performing markets in the region who contribute nearly half of the segments company-operated margin dollars.

In addition, France and other markets realized labor productivity gains as part of their overall efforts to control costs and enhance efficiencies within the restaurants. Commodities increased about 2% for the quarter and for the full year, Europe's projected increase is now slightly lower at 2% to 3%.

Europe is a collection of 39 markets, so our price increases vary by market with Russia at the higher end due to its inflation albeit a little less than a year ago and all other markets averaging about 1.5% year-over-year. Similar to the U.S. we have less pricing power in 2013 versus a year ago.

In addition, given the economic environment in nearly all of our markets we're balancing a stronger emphasis on value with compelling premium products to effectively manage average check and margins. We have a strong underlying business in Europe and we believe we are making the right strategic decisions and value investments to protect and grow the band over the long term.

In Asia-Pacific, Middle East and Africa, company-operated margins for the quarter decreased 100 basis points to 14.3% due to new restaurant openings mainly in China along with higher labor costs throughout the segment. To a lesser extent, avian influenza impacted our sales and margins in second quarter, but our team work hard to manage expenses and other controllables to mitigate some of the negative impact.

G&A discipline remains an area of focus. We seek to grow sales and revenues faster than our G&A spend. Year-to-date, G&A as a percent of revenues was 8.8% versus 9% a year ago, which included our biennial Worldwide Convention. For the full-year, as part of our ongoing efforts we have reduced our G&A spend and now expect it to be relatively flat versus the prior-year due in part to lower incentive compensation and efficiencies we have identified.

The growth in revenues and operating income within our franchise business model translates into significant generation of cash. As Don reiterated, our first priority for this cash remains reinvesting in our business to drive future growth and returns. In light of the current environment we have trimmed our 2013 capital expenditure forecast by $100 million to about $3.1 billion. Although we will open about 50 fewer sites, we believe this is prudent given the short-term pressures. More importantly it will not undermine our long-term growth potential and the quality and returns of our new restaurants remain very solid.

The remainder of our capital is being invested in existing restaurants, in part through reimaging more than 1,600 location?s, we?re making steady progress in our efforts to modernize our brand with about 50% of our exteriors and about 60% of our interiors on a global basis reflecting the current contemporary look. In the U.S. this year we will touch about 10% of our traditional brief standing portfolio through a combination of reimaging, rebuild and new restaurants, this will put us close to the 50% mark. Within the next year a U.S. customer more often than us will experience our brand in a more modern and relevant manner than before. We?re excited about the potential that this brings to our largest market.

Lastly, let me touch on foreign currency translation which negatively impacted second quarter results by $0.02 more than originally forecasted as several currencies weakened against the U.S. dollar during the quarter. At current exchange rates we expect a negative impact of $0.01 to $0.02 on third quarter EPS with a full-year negative impact of $0.07 to $0.09. As usual though, please take this as directional guidance only because rates will continue to change as we progress throughout the second half of the year.

Despite flat to declining and formal eating out markets around the world McDonald?s grew revenue operating income and earnings per share in second quarter. Our results underscore the solid performance, the solid platform from which we are operating.
