Frequently Asked Questions Estate Planning Handout

Whenever someone talks to me about estate planning, they start using a bunch of terms that I am unfamiliar with?? What do all those words mean to me??

It is common for attorneys and other professionals to use certain estate planning terms and phrases that are familiar in the estate planning world, but can be confusing to those who don?t work in it every day.? So let?s start by getting a few key definitions out of the way:

  • ?Last Will and Testament: ?A Will is a fairly straightforward legal document.? In your Will, you outline who your family members, who you designate to receive your assets upon your passing, and who is responsible for administering your estate (Personal Representative) after your passing.? A Will is also the document used to nominate a guardian for your minor children.? Your Will has no effect during your lifetime.? Once you pass away, your Will becomes active.? Your Personal Representative will then be responsible for opening a Probate through the court, admitting your will to Probate, and administering your assets throughout the Probate proceedings.? Ultimately, the Probate Court will distribute your assets to your beneficiaries.

  • Revocable Living Trust:? A Revocable Living Trust is a trust which you create during your lifetime.? The fact that the trust is revocable means that it may be changed or terminated at your wish.? More generally, a trust is a legal entity that is created to hold and manage your property during your lifetime, through an incapacity, and ultimately to administer and distribute your estate to your beneficiaries upon your passing.? During your lifetime you have complete access to all assets held by your Revocable Living Trust, just as you do now.? Your Living Trust holds title to all property, and allows for seamless, consolidated management of your assets during your lifetime, through any incapacity, and even after your death.? While you are alive and well, you will serve as the Trustee and Beneficiary of the trust, allowing you full access and control.? Should you become incapacitated, someone else will be nominated to take over as Trustee to manage the assets, and you will remain the Beneficiary.? Upon your passing (or the passing of the second spouse for a married couple), you will have nominated someone to take over as the Trustee to administer your estate for the benefit of your named Beneficiaries (i.e. children, siblings, charities, nieces/nephews, other family, friends).? This post death administration of your trust will be handled privately, by the person or entity you have nominated to serve as Trustee.
  • Pour Over Will: If you draft a Living Trust, your Pour Over Will acts as a backup to ensure that all assets are distributed according to your Trust plan.? This way, if you pass away with assets that are not properly funded to your trust, your Pour Over Will is able to fund them to your trust after your death.? This is also the document you use to nominate Guardians for your minor children upon your passing.
  • Personal Representative: Your personal representative is the person you nominate to be responsible for administering your will after you have passed away.? They will be responsible for opening the Probate with the court, filing all required documents and paperwork, appearing at any court hearings, and ultimately distributing the assets to your beneficiaries under the guidance of the Probate Court.
  • Probate: This is the court driven process by which an estate is administered for assets that pass under a Will.? It is a public court procedure that is overseen by a judge.? The process includes filing of your original Will with the Probate Court, nomination of the Personal Representative, the filing of an inventory of all assets with the court, a required publishing of a notice to creditors, a final accounting, and ultimately, the distribution of your assets to your beneficiaries.? Probates can vary widely in length, but on average they last anywhere from 9-18 months from the date the Probate is started.
  • Grantor: You are the Grantor, as it is the person who sets up the trust.? It is generally also the person who funds the trust initially.
  • Trustee:? The Trustee is the person who holds legal title to the trust assets, is responsible for controlling trust assets, investing the assets and administering the trust assets in a post death situation.? Initially, you will be the Trustee of your Revocable Living Trust.? You will also nominate Successor Trustees to take over in the event you are incapacitated or pass away.
  • Beneficiary:? The Beneficiary is the person who has beneficial use of the trust assets.? Initially, you are the Beneficiary as well.? Since you are typically the lifetime Beneficiary, you will maintain use of and access to your assets during your lifetime.? You will designate who the Beneficiaries of your Trust are to be after your death, and the Trustee will be responsible for distributing assets to your named Beneficiaries after you have passed away.

?What does it mean for my Beneficiaries to inherit ?in trust? or for me to create ?asset protected trust shares? for my children?

Generally speaking, there are two ways that a beneficiary can inherit assets: outright or in trust.? A beneficiary inheriting outright is very easy to comprehend, as it essentially just means they will get a check written out in their name or property titled in their name when the distribution from your estate is made.

Inheriting in trust can be a little more obscure, and can mean a lot of different things.? At its simplest form, inheriting in trust simply means that rather than inheriting property titled in their name, your children or other beneficiaries will receive property titled in the name of a trust of which they are the beneficiary.? From there, the design of these types of inherited trust shares can vary widely.? To give you a sampling of the types of beneficiary trusts that can be created, here are a few of the more common general types:

  • Step Distribution Trusts: The general concept here is that your beneficiary will receive your assets in trust, with a separate Trustee managing the assets.? Then, at certain ages or benchmarks, portions of the Trust will be distributed to the beneficiary outright.? For example, this type of trust may say that a beneficiary shall receive 1/3 of their trust share at age 25, 1/3 at age 30, and the remainder at age 35.? This type of trust is designed to protect the beneficiary from spending it all at once by only giving them access to pieces of it at certain ages.
  • Asset Protected Trust Shares: With an asset protected trust share, the goal is to protect the inherited assets from a beneficiaries liabilities, for example, a potential divorce, a bankruptcy, creditor problems, and lawsuits.? The assets are titled in the name of a trust for the benefit of the beneficiary, and distributions are limited to ascertainable standards, giving the assets held by the trust protection from the beneficiary?s personal liabilities.? These trusts also keep the assets separate, so that they are not considered as part of any divorce the beneficiary may go through.? Often times there will be an Independent Trustee up through a certain age of the beneficiary (say 25 or 30), and then at that point the Beneficiary is able to become the Trustee as well.? This means that they will gain full control over the trust assets, so that they could distribute as much of it as they desire.? However, the trust remains intact, so to the extent that they leave assets in the trust, they will remain protected from some of their personal liabilities.
  • Spendthrift Trusts:? In some cases, the biggest liability that parents are concerned with protecting a child from is their own spending habits.? In these cases, the trust may be designed in such a way as to limit the amount of the trust that the beneficiary has access to, usually described as a certain dollar amount or certain percentage of the trust assets on an annual basis.? The beneficiary may be required to meet certain requirements or incentive provisions before gaining access additional distributions or to any distributions at all.

What does it mean to ?fund? my Living Trust?? How important is the titling of property with respect to my plan?

When attorneys use the phrase ?funding your trust?, what they are referring to is the process of retitling assets and changing beneficiary designations to ensure that your trust is able to control all of your property.? An ?unfunded? trust is like a car with no gas ? it may look nice, but it simply is not going to work!? If the trust does not hold title to your assets, then it cannot control them, and therefore your assets will not be managed or distributed according to the terms of your trust.? If you pass away with and unfunded trust, your estate will go through the probate process, and while your assets may ultimately get funded to your trust at this time through your Pour Over Will (see below), the cost to administer your estate will be much higher, you will lose all privacy associated with a trust, and you will have missed out on all of the lifetime benefits of having a Living Trust.

Beyond simply having assets funded to your trust, it is important to remember that how an asset is titled can have a substantial impact on its distribution upon your death.? For example, if you hold asset titled as joint tenants with another person, regardless of what your will or trust says, when the first of the owners passes away, their interest in the property will pass to the other joint tenant.? Conversely, if you hold title to assets as tenants in common, you are free to pass your interest in the property to whomever you choose through your estate planning.? Also, if an asset has a beneficiary designation or transfer on death designation attached to it, that asset will pass by contract directly to the named beneficiary upon your death, and will not be affected by the provisions of your will or trust.? This is why it is imperative to ensure that your assets are properly funded in coordination with your overall estate plan.

Be sure to ask your attorney whether they will assist you in funding your trust, and if they do, whether they will charge you separately for the funding process.? Remember, if your trust is unfunded, you have essentially just paid more money to end up with a Will the centerpiece of your estate plan.

What are the tax consequences of having a Revocable Living Trust?

During your lifetime and as long as you are the trustee and managing the trust all of the items which you place into the trust will be taxed using your social security number, therefore you will not see any change at all.? All income will be reported on your normal income tax return as it was before you set up the trust.? Proper planning with your Revocable Living Trust will allow you to minimize your estate taxes especially for a married couple.

?If I want to change or revoke the Revocable Living Trust, how do I go about doing this?

Changing or revoking a Revocable Living Trust is no different than making changes to your will.? Generally to amend or revoke your Trust you must have proper papers prepared to reflect any changes.? If you decide that you want to change or revoke your trust you should get in touch with your attorney in order to make the changes or to properly revoke it.

What happens to my Revocable Living Trust upon my death?

Upon your death your trust will become irrevocable and is no longer able to be amended or changed.? All of the assets that were in your trust will still be considered in your estate for tax purposes and the Successor Trustee will then take over duties and distribute the assets according to your particular estate plan.? Please note the Trustee may also be responsible for all required steps that are part of the administration of your estate, such as insuring that a final tax return is prepared and upon distribution of the trust that a final accounting has been done.? It is a good idea for the Trustee at the time to contact your attorney to ensure that all things are properly concluded at your death.

If I have a Revocable Living Trust do I still need other estate planning documents?

As mentioned before the Revocable Living Trust is only a part of your estate plan.? There are several other documents that may contribute to the make-up of your comprehensive estate plan, such as a Pour Over Will, Durable Power of Attorney (for finances), a Healthcare Power of Attorney, a HIPAA Authorization, and a Living Will.? Below are some brief definitions of these documents:

  • Durable Power of Attorney (for finances):? This document is used to nominate someone to handle financial and property management decisions during your incapacity.? You choose an agent to ?fill your shoes? and generally grant them the power to manage your assets and day-to-day decision making in the event that you are unable to do so for yourself.? This document is also used to nominate temporary guardians for your minor children in the event that both you and your spouse are incapacitated at the same time.? Without this document, your loved ones would have to go to court and begin a Guardianship proceeding in order to have someone appointed to make financial decisions for you.
  • Healthcare Power of Attorney:? Your Healthcare Power of Attorney (HCPOA) is used to nominate someone to make healthcare decisions on your behalf in the event that you are unable to make decisions for yourself.? In this document, you have the opportunity to spell out some of your specific health care wishes, as well as authorize your healthcare agent to make or not make certain types of decisions on your behalf.? Often the focus of the document is on what powers your grant and what your feelings are regarding end of life decision making.? Without this document, no one (not even your spouse) is authorized to make such decisions for you, and your loved ones would have to go through the court driven Guardianship proceeding to have a Guardian appointed to make healthcare decisions for you.
  • HIPAA Authorization:? The HIPAA Authorization is your opportunity to authorize certain family members and close friends to have access to your medical records during a potential incapacity, so that doctors are able to communicate with your loved ones regarding your treatment and condition.? Without this document, only you have access to your medical records, which means that friends and family members (including your spouse) can be shut out from information if you are incapacitated.
  • Living Will:? If you choose to execute a Living Will, you are making a statement directly to any physicians treating you that if you are in a persistent vegetative state or have a terminal condition where death is imminent, that you do not want your life artificially prolonged through the use of feeding tubes and breathing machines.? This is a direct statement to healthcare providers regarding your intentions in end of life situations.

Here's what would happen if every state split its electoral votes

The outrage wholesaler known as the Virginia legislature?the people who brought you the transvaginal ultrasound?considered legislation this week to allot the state?s 13 electoral votes to the winning presidential candidate in each of the state?s congressional districts, rather than to the overall winner of the statewide vote. The bill died in committee, but you can expect to hear about this idea a few more times. National Journal?s Reid Wilson reported in December that several Republican-controlled states that voted for President Barack Obama are considering a similar policy.

Two states, Maine and Nebraska, already split their electoral votes this way, and the primary effect is to aggravate those of us who make election maps for a living. The states currently have two and three members of the House of Representatives, respectively, and tend to reliably elect Democratic and Republican candidates and presidents, also respectively. (Obama snagged one of those Nebraska electors in 2008, which was uncommon.)

Virginia is a different story.? Even as the state has gone from reliably Republican to highly competitive, Republicans dominate the House delegation. There is a simple explanation: The state is highly gerrymandered, with the Democratic base concentrated into a few districts.

It would be highly unfair for only a few states to adopt this system, but one might think it would work out OK if every state were to split its electoral votes this way. In fact, the way congressional districts are presently drawn, a national tally of congressional districts would often be even less fair than if just a few states did it.

In the following interactive, you can see how the 2000, 2004 and 2008 elections would have played out if each state had split its electoral votes. (Because not all states report their election results by district, it will be awhile before we have reliable 2012 figures.)

The 2000 election is particularly striking: George W. Bush lost the popular vote but comes out with 62 more electoral votes than Al Gore. (This assumes you award each state?s extra two electors by the winner of the popular vote in each state, though you can try it by the winner of the most congressional districts as well, as the Virginia law proposed.)

In all cases, the split system benefits Republicans, though not always unfairly. The 2008 election, divided this way, produces a result that much more closely resembles the popular vote than the state-by-state results do.

That?s assuming, however, that your definition of ?fair? in some way encompasses the idea that the winner of the popular vote should win the election. In fact, efforts to undermine the popular vote are as old as the country. The most notable example is the Senate, which awards equal power to Wyoming (population 576,412) and California (population 38,041,430).

In essence, the entire country is gerrymandered along state lines. Traditionally Democratic voters are concentrated in smaller regions that have a disproportionately small presence in the electoral college, given that even the sparsest states get a minimum of three electoral votes.

I am strongly in favor of redistricting the country, state border by state border. In the interim, any effort to allot presidential electors by congressional district will increase the likelihood that a man or woman will once again win the highest office without winning the most votes.

Four questions that will be answered by UFC 156

UFC 156 is the UFC's annual Super Bowl weekend card, and as usual, it's a big one. A former champion will drop down to try to win a belt in a new weight class, a Strikeforce champion will try to win a shot at the UFC heavyweight belt, and these questions will be answered.

What have the layoff and injuries done to Jose Aldo? By the time he walks into the cage on Saturday night, it will have been 385 days between Aldo's fights. He had several injuries and had bouts canceled twice. It's hard to say if we'll see the invincible Aldo who fought Chad Mendes last January.

How does the new weight class suit Frankie Edgar? Since starting as a lightweight, Edgar has had doubters because he was on the small side for 155 lbs. It worked for him, as he did win and defend the UFC lightweight championship. Now that he's lost it, he's trying again for the belt at 145 lbs. Will the new weight class fit him even better than lightweight did?

Did Alistair Overeem look past Antonio Silva? At the pre-fight press conference, Overeem called the bout with Silva a warm-up fight.

"Obviously I've not fought for 13 months, so it's going to be a good test for me," Overeem said. "I should not overlook 'Bigfoot' Silva, but if I look at my training and what I do to my sparring partners, I should not make 'Bigfoot' Silva more than he is. He should not be a problem, but that's why it's a warm-up fight."

That's dangerous ground to tread, as looking past the man who is about to punch you makes it lightly you'll get knocked out. Overeem should beat Silva, but the one way he can lose is to not take Silva seriously.

Can Jon Fitch use his wrestling to neutralize Demian Maia? You may not like to watch Fitch's matches. You may have used the words "lay and pray." But you cannot deny Fitch's ability to use his wrestling to hold off opponent's strengths. This time, he'll be using it against Maia, whose submissions and jiu-jitsu are tough to beat. This is Fitch's chance to show he can hold off even the best ground games.

Captured Islamists say Malian military tortured them ? RT

Three suspected Jihadists who were arrested in the liberation of Timbuktu have said they were tortured by Malian soldiers who used a method similar to waterboarding. There are also reports of child soldiers being used by the Malian army.

?The three suspected militants were being held in an earthen cell in the remains of a military camp in Timbuktu, according to journalists from AP who spoke to the men.

Timbuktu was freed last weekend by Malian and French soldiers after 10 months under the rule of radical Islamists, who had imposed Sharia law in the town.

The men, tied together in the cell with one handcuff and a turban, all admitted to the journalists to having been members of Ansar Dine, which has links to Al-Qaeda.

?To force me to talk they poured 40 liters of water in my mouth and over my nostrils, which made it so that I could not breathe anymore. For a moment I thought I was actually going to die,? said one of the men who said he was from the central Malian town of Niono.

The other two soldiers spoke of similar treatment, although their account could not be independently verified.

A Malian army colonel, Mamary Camara, told reporters that Malian forces arrested the men in the town of Lere and that one of them was from Libya and had been wearing a foreign military uniform and said he had a wristwatch with a memory card that he allegedly used to communicate with other jihadists.

The Islamist who was allegedly from Libya gave AP contradictory information about his origin. First he said he was born in Mali but was of Libyan dissent and then said he was from Tripoli but had lived in Mali for years. He also initially denied being part of Ansar Dine, but then admitted to belonging to the movement. He was visibly frightened; cowering in his cell, according to AP.

There are also reports emerging from Mali of child soldiers being used by the army. A freelance journalist in Mali, Gonzalo Wancha, told RT that in the town of Diabli many of the military forces were heavily armed child soldiers.

?My brother was attacked by a group of militants. There were children among them. One of the children fired at him. My brother fell and was riddled with bullets,? Mohamed Kandanku, a local, told Wancha.

The exact number of underage youths or their exact age could not be verified.

Both allegations come as both Human Rights Watch (HRW) and Amnesty International issued reports Friday of misconduct against the Islamists by the Malian army.

Wancha said that civilians had been killed by the Malian army in Sevare, in the center of the country, and had dumped their bodies in a well.

Human Rights Watch also reported that witnesses had seen Malian soldiers interrogate passengers at a bus station in Sevare, who they suspected of having links with Islamic extremist groups.

?Before the soldiers marched them off, many of the detained men frantically tried to find someone in the crowd who could vouch for them and verify their identity. They were driven or marched to a nearby field, where they were shot and their bodies dumped into one of four wells,? the HRW report said.

The Friday reports also stated that human rights abuses have been committed by the Islamists, who reportedly executed at least seven Malian soldiers, five of whom were wounded during the battle for the town of Konna.

France has said that it wants to hand over responsibility for the mission to the Malian army and the armies of other West African countries.

The Malian government has promised to investigate allegations of torture and other human rights abuses by its military.

Fewer Americans count on retiring by 65

Warren Buffett, 82, is among the most high-profile Americans who have continued their careers well past age 65.

If you?re planning to work past age 65, you may find that you have a surprising amount of company among your peers.

A larger chunk of Americans are working into their late 60s and even beyond, part of a long-term trend that has continued despite the tight job market of the past five years and is expected to increase in coming decades.

?It?s one of the most important changes in the labor force over the last generation,? said Robert Johnson, director of The Urban Institute?s Program on Retirement Policy.

Most Americans?still stop working by the time they hit?65. But about 18.5 percent of Americans age 65 and over were working in 2012, according to the Bureau of Labor Statistics. That?s a nearly 8 percentage point increase from a low in 1985, when just 10.8 percent of Americans over age 65 were still at work.

The trend toward working past age 65 is an about-face from the decades that followed World War II. From the late 1940s through the mid-1980s, the percentage of people over age 65 who were in the labor force generally fell as workers took advantage of pensions and Social Security payments that gave them plenty of financial incentive to quit working by age 62 or even before.

These days, however,?people have an incentive to work longer and wait to collect more lucrative Social Security benefits.

Perhaps more importantly,?more companies have moved from pension-type retirement plans to 401(k)-type plans. Johnson noted 401(k) plans can have the opposite effect on retirement, because they aren?t as generous and provide incentive for people to work longer so they can bulk up their funds more.

?The erosion in traditional pension plans has really encouraged people to work longer,? he said.

Still, not everyone is healthy enough to work past age 65, and many people don?t want to. Alicia Munnell, director of the Center for? Retirement Research at Boston College, said her research has shown that people ages 55 to 64 are more likely to keep working for a few extra years because they didn?t think they could afford to retire.

But she said people who are still working at age 65 and beyond are generally healthier, wealthier and more educated than those who have stopped working, and she thinks a significant chunk are doing so at least partly by choice.

?When you?re talking with people older than 65, people are healthier and better educated and jobs are less physically demanding, and that makes it attractive to stay in the labor force,? she said.

Munnell noted that not all professions are friendly to older workers, so working longer isn't always rewarding or even pleasant. But in some?fields - such as academia -?it is more common and acceptable to stay at work past age 65.

There are also plenty of examples of famous older people, such as Warren Buffett, 82, who are clearly staying on the job more for love than money.?

The percentage of people 65 and over who are working has continued to increase?in the past five years, even though?the overall labor force participation rate has fallen because the tight job market has made it so hard to find jobs.

Phillip Levine, an economics professor at Wellesley College who has studied retirement trends extensively, said he doesn?t think the recession itself has played a big role in exacerbating the existing trend of older workers staying in the labor force longer.

His research has shown that the Great Recession has?had an opposite effect on many workers who were close to retirement, pushing them into early retirement because they lost a job and couldn?t find a new one.

But in years to come, he does expect the Great Recession will play a role in increasing the number of people who work past age 65. That?s because younger people who were unemployed for several years during this period will then work a few extra years to make up for the earnings, and retirement contributions, they lost during their stints of unemployment.

Johnson, from The Urban Institute, said the continued decline in pension plans also will likely play a role in more people choosing to hold onto their jobs longer than their parents or grandparents.

?The idea of retiring at age 62 ? I think a lot of young people think that?s a quaint idea,? Johnson said.

Menendez: reimbursed donor $58.5K for 2 trips

WASHINGTON (AP) ? Sen. Robert Menendez's office said Wednesday night that he reimbursed a prominent Florida political donor $58,500 for the full cost of two of three trips Menendez took on the donor's plane to the Dominican Republic in 2010.

There was no public disclosure.

"The senator paid for the two trips out of his personal account and no reporting requirements apply," said Menendez spokeswoman Tricia Enright.

Details of Menendez's trips emerged as his office said unsubstantiated allegations that the senator engaged in sex with prostitutes in the Dominican Republic are false.

The FBI searched the West Palm Beach, Fla., office of the donor ? eye doctor Salomon Melgen ? on Tuesday night and early Wednesday, but it was unclear if the raid was related to Menendez, a New Jersey Democrat.

A third trip by Menendez aboard Melgen's plane ? a campaign fund-raising journey to the donor's residence in the Dominican Republic ? took place in May 2010. That trip was reported to the Federal Election Commission, said Enright.

Menendez categorized the other two trips as personal. The first was from Aug. 6-9, 2010, a round trip from South Florida to the Dominican Republic. The second personal trip was from Sept. 3-6, 2010, from New Jersey to the Dominican Republic and back.

Menendez could have invoked what is known as a "friendship exemption" regarding the two personal trips, which would have required the senator to report the travel to the Senate Ethics Committee as a gift. Instead, Menendez chose to reimburse the full cost of the two trips.

The Daily Caller, a conservative website, reported shortly before the November election that Menendez traveled on Melgen's private plane to the Dominican Republic to engage in sex with prostitutes.

Menendez's office said that any accusations of engaging with prostitutes "are manufactured by a politically motivated right-wing blog and are false."

At FBI headquarters in Washington, spokesman Jason Pack said the bureau "cannot comment on the existence or status of an investigation." Justice Department spokeswoman Tracy Schmaler also declined to comment.

On Tuesday, Menendez became chairman of the Senate Foreign Relations Committee, succeeding Sen. John Kerry, D-Mass.

Records filed in Palm Beach County show an Internal Revenue Service lien against Melgen of more than $11.1 million for unpaid taxes from 2006 through 2009. Prior liens for taxes from 1998 to 2002 were subsequently withdrawn, records show.

Earlier Wednesday, Menendez's office said Melgen has been a friend and political supporter of the senator for many years and that the three trips that Menendez took have been "paid for and reported appropriately." Menendez's office later changed the statement's wording to specify that the trips had been "paid for or reported appropriately" to correct the impression that all three trips had been publicly reported.

Melgen is involved in numerous businesses, all sharing the same address in West Palm Beach, according to records filed with the Department of State in Florida.

Late Tuesday and early Wednesday, FBI agents were seen inside the West Palm Beach building, walking its halls and standing beside shelves full of files.

The Daily Caller began publishing stories on its website about Menendez and Melgen on Nov. 1, when it reported that two women from the Dominican Republic said Menendez paid them for sex earlier in 2012. Prostitution is legal in the Caribbean nation.

Melgen is listed as having an ownership interest in DRM Med Assist, which Federal Aviation Administration records show is the owner of a CL-600 Challenger plane. Flight records for the aircraft were not immediately available.

Melgen, a registered Democrat, has made $193,350 in political contributions since 1998, including $14,200 to Menendez, according to Federal Election Commission records. Menendez was chairman of the Senate Democratic Campaign Committee, which raises money for Democratic Senate candidates, from 2009-2011.

Menendez, a lawyer, is a former mayor of Union City, N.J., and also served in the New Jersey state General Assembly and the New Jersey state Senate. He is divorced and has two children.

Melgen, 58, is a native of the Dominican Republic, where he earned his medical degree from the Universidad Nacional Pedro Henr?quez Ure?a in 1978. He has lived in the U.S. since at least 1980, holding an internship, residency and fellowship at hospitals in Connecticut, Missouri and Massachusetts, according to records filed with the Florida Department of Health.

Melgen has been licensed to practice in Florida since 1986 and purchased the West Palm Beach plot of land where he built his main office in 1991. Over the years, Melgen has become regarded as a top ophthalmologist, speaking at conferences and even operating on then-Gov. Lawton Chiles in 1997. The governor later appointed Melgen to a state panel on HMOs.

Calls to Melgen's offices Wednesday were forwarded to an answering service where receptionists told callers to try back Thursday. Calls to Melgen's home in North Palm Beach, which is appraised at $2.1 million, went unanswered.

On the website for his medical practice, Melgen writes: "I am always asked what sets me apart from most other doctors, and I would have to say that I do not consider myself to be a 'cookbook' physician. My patients are my number one priority, and when I am looking to treat a diagnosis I try to look at all the data at hand and extrapolate the best treatment instead of solely adhering to what the current 'standard' of treatment may be."

Israel sends message with dawn attack in Syria

In an early morning air raid Israel targeted weapons being transfered from Syrian President Assad's military to Hezbollah. Official secrecy shrouded the event, which reportedly killed two in Jamraya (located between Damascus and Lebanon's border).

Israeli jets bombed a convoy near Syria's border with?Lebanon?early on Wednesday, sources told Reuters, apparently targeting weapons destined for Hezbollah in what some called a warning to?Damascus?not to arm?Israel's Lebanese enemy.

Syrian state television accused?Israel?of bombing a military research centre, at Jamraya between the capital and the nearby border, but Syrian rebels disputed that, saying their forces had attacked the site. No source spoke of a second Israeli strike.

"The target was a truck loaded with weapons, heading from Syria?to?Lebanon," said one Western diplomat, echoing others who said the convoy's load may have included anti-aircraft missiles or long-range rockets. Several sources ruled out the presence of chemical weapons, about which?Israel?has also raised concerns.

Diplomatic sources from three countries told Reuters that chemical weapons were believed to be stored at Jamraya, and that it was possible that the convoy was near the large site when it came under attack. However, there was no suggestion that the vehicles themselves had been carrying chemical weapons.

The overnight raid followed warnings from?Israel?that it was ready to act to prevent the revolt against President Bashar al-Assad leading to Syria's chemical weapons and modern rockets reaching either his Hezbollah allies or his Islamist enemies.

A source among Syrian rebels said an air strike around dawn (0430 GMT) blasted a convoy near the border: "It attacked trucks carrying sophisticated weapons from the regime to Hezbollah," the source said, adding that it took place inside Syria.

Syrian state television said two people were killed in a dawn raid on a military site at Jamraya, which lies in the 25-km (15-mile) strip between?Damascus?and the Lebanese border. It described it as a scientific research centres "aimed at raising the level of resistance and self-defence".

It did not mention specific retaliation but said "these criminal acts" would not weaken Syria's support for Palestinians and other groups engaged in "resistance" to?Israel.

Several rebel sources, however, including a commander in the?Damascus?area, accused the authorities of lying and said the only attacks at Jamraya had been mortar attacks by insurgents.

A regional security source said?Israel's target was weaponry given by Assad's military to fellow Iranian ally Hezbollah:

"This episode boils down to a warning by?Israel?to Syria?and Hezbollah not to engage in the transfer of sensitive weapons," the source said. "Assad knows his survival depends on his military capabilities and he would not want those capabilities neutralised by?Israel?- so the message is this kind of transfer is simply not worth it, neither for him nor Hezbollah."

With official secrecy shrouding the event, few details were corroborated by multiple sources. All those with knowledge of the events - from several countries - spoke anonymously.

There was no comment from the?Israeli government?nor Hezbollah.?Israel's ally the?United States?declined all comment. A Lebanese security source said its territory was not hit, though the?army?reported a heavy presence of Israeli jets through the night after days of unusually frequent incursions.
